Last May we were forced to immediately file an action for a due process hearing when we were notified Drew was being forced by the school district to graduate in a matter of days. It appeared that a scheduled IEP meeting to discuss Drews future education was a red herring, and the matter was clarified when we received the School Boards very negative reply to our request for a due process hearing. We were in shock. We had been so nave. I am hopeful, however, that you may take a different view of how a school district should go about providing Exceptional Student Education for the developmentally disabled. I am also hopeful that you will not endorse the manner in which Drew and his rights have been treated. But, given our recent history, it is very difficult for my family to assume the innocence and well meaning of the district, even with a new superintendent in place. As you may be aware, we have only 30 days to appeal the recent ruling of the administrative judge. I have hired Timothy Weber, an appellate attorney with Battaglia, Ross, Dicus & Wein, P.A. , to represent Drew in Federal Court. I had wanted to talk with you first, but given the deadline and closed offices of the school district last week, I have had to pull the trigger and tell Mr. Weber to begin preparing the appeal. We will not be caught defenseless again. This morning I picked up the invoices from Edwards & Scharff, LLP that the Polk County School Board has been paying. My guess is that much of the $33,000 paid in September and October to Greg Scharff relates to the efforts of the district to keep Drew out of school. I would estimate that my legal fees to date have been about $15,000. That does not include the expert witnesses. I estimate that between today and December 9th, my family will be incurring $2,000 a day in legal fees towards our upcoming federal case. But all of this is crazy. I would like to meet with you as soon as it is possible. On Tuesday, the 30th, I can meet with you from 12 to 2, or anytime after 4:30 p.m. Unfortunately, I have a real estate closing which I must attend. On Wednesday, I will clear my calendar for whatever time may be convenient for you to meet with me. On Thursday, from 10:30 a.m. to 1:30 p.m, I must attend an IEP meeting as an advocate for a seven year old at the Dwight Smith School. Other than the time of the IEP, I will be glad to meet with you at your convenience. On Friday, Saturday, or Sunday, I will meet with you at any time. On Monday at noon I will be leaving with Drew to go to Fort Lauderdale. Tuesday morning Drew will be receiving dental treatment through a program at Nova University for those with developmental disabilities. I will be back on Wednesday and available to meet with you. You may find this difficult to believe, but my family believes we are fighting for all of the ESE kids in the county, not just Drew. A recent spreadsheet of data I compiled from the LEA Profiles from each of Floridas 67 counties can be found on my website, ESEparents.org. From that spreadsheet a convincing argument can be made that Polks ESE program ranks dead last of Floridas 67 counties and leaves more disabled children behind than any county in the state. I have been trying to make an earnest effort to change this performance for the last 4 years outside of the courts. This spreadsheet confirms what I already knew. My efforts have had little impact other than putting Drews education at risk. That means I must begin again. It would be great if the efforts could be made outside the court system and not at Drews expense. There are so many issues I would like to discuss with you. I would be delighted to work with you to make real progress for Drew and all of the ESE students in Polk County.
